The sudden rise in interest is potentially due to the recent merger of Microsoft and Activision Blizzard, which is expected to close by October 18, 2023.

The reason behind the unavailability of Modern Warfare 3 on Game Pass is Activision’s ongoing marketing agreement with Sony’s PlayStation. The deal prohibits Modern Warfare 3’s inclusion on a service like Game Pass despite the merger agreement between Microsoft and Activision Blizzard.
